1. Acceptance of these terms

This website is operated by Code Capital Development Management L.L.C-FZ ("Code Capital", "we", "us" or "our"), a development management and development-related commercial advisory business based in Dubai, United Arab Emirates.

By accessing or using codecapital.ae, you agree to these Terms of Use. If you do not agree, please do not use the website. If you use the website for an organisation, you confirm that you are authorised to do so on its behalf.

2. Information only

The website provides general corporate information and perspectives on real estate development. Its content is not an offer, recommendation, commitment, representation or invitation to invest, acquire, dispose of, finance or participate in any property, security, fund, joint venture or transaction.

Nothing on the website is legal, tax, financial, investment, valuation, brokerage, engineering or other regulated professional advice. You should obtain advice appropriate to your circumstances before acting on any information.

3. Services and client relationships

Code Capital provides development management and development-related commercial advisory services. Legal, tax, regulated financial, investment, brokerage and other regulated professional services, where required, are provided by appropriately licensed third-party advisers.

Using the website, contacting us or submitting an enquiry does not create a client, adviser, fiduciary, partnership, agency or other professional relationship. Any appointment or mandate is subject to due diligence, internal approval and a separate written agreement signed by the relevant parties.

4. Accuracy and availability

We aim to keep the website useful and current, but development markets, costs, regulations and project circumstances change. We do not promise that content is complete, accurate, current, suitable for a particular purpose or free from error. Illustrations, examples and perspectives may be simplified and should not be treated as project-specific conclusions.

We may change, suspend or withdraw any part of the website without notice. We do not guarantee uninterrupted access or that the website will always be secure or free of harmful code, although we take reasonable steps to maintain it.

5. Intellectual property

Unless stated otherwise, Code Capital or its licensors own the website and its content, including its name, logo, text, design, graphics, diagrams, photographs and underlying software. These materials are protected by applicable intellectual property laws.

You may view the website and print or download a reasonable extract for your own internal, non-commercial reference. You must not reproduce, republish, modify, distribute, sell, license, remove rights notices from, or create derivative works from website content without our prior written permission. No licence is granted to use the Code Capital name, logo or other branding.

6. Acceptable use

You must use the website lawfully and must not:

  • attempt to gain unauthorised access to the website, server or connected systems;
  • introduce malware, harmful code or excessive automated traffic;
  • interfere with the website's operation, security or availability;
  • use the website to commit fraud, impersonate another person or infringe any person's rights;
  • scrape, harvest or systematically extract website content or contact information; or
  • use our content or branding in a misleading way or suggest our endorsement without permission.

We may restrict access where reasonably necessary to protect the website, our users or our rights.

7. Third-party links

The website may link to external websites or services for convenience. We do not control or endorse them and are not responsible for their content, availability, security or privacy practices. Your use of a third-party service is governed by that service's own terms and policies.

8. Enquiries and confidential information

You are responsible for ensuring information submitted to us is accurate, lawful and does not infringe another person's rights. Do not send confidential, commercially sensitive or privileged material through the website unless appropriate confidentiality arrangements are already in place. We cannot treat an unsolicited enquiry as creating a duty of confidentiality by itself.

Our handling of personal data is explained in our Privacy Policy.

9. Limitation of liability

To the fullest extent permitted by applicable law, Code Capital and its officers, employees and representatives are not liable for loss arising from reliance on general website content, inability to access the website, or use of a third-party website. This includes indirect, incidental, special or consequential loss, loss of profit, opportunity, data, goodwill or anticipated savings.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation. Your mandatory rights under applicable law are not affected.

10. Changes to these terms

We may revise these terms to reflect changes to the website, our business or applicable law. The revised terms take effect when published here. The update date at the top of the page shows when they were last changed.

11. Governing law and jurisdiction

These terms and any non-contractual obligations arising from them are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Subject to any mandatory law, the courts of Dubai have exclusive jurisdiction over disputes relating to the website or these terms.

If any part of these terms is found invalid or unenforceable, the remaining parts will continue in effect. A failure to enforce a right is not a waiver of that right.

12. Contact us
